Scope
These Terms & Conditions apply to purchases made directly through the Whodunit Games online shop.
Whodunit Games offers digital products, in particular downloadable and printable murder mystery games and related game materials. No physical product will be shipped unless expressly stated otherwise.
The version of these Terms & Conditions applicable at the time of the order will apply.
The contract language is English.
Purchases made through third-party marketplaces, such as Etsy, are additionally subject to the terms and checkout conditions presented by the respective marketplace.

Digital products
The products offered in the shop are digital content provided electronically.
The individual product description specifies the contents of the game, intended number of players, file format and any relevant technical or printing requirements.
The customer is responsible for ensuring that they have suitable equipment and software to open and, where desired, print the supplied files.
No physical game box or printed materials are included unless expressly stated in the product description.
German consumer law requires information about the functionality and relevant compatibility of digital products to be provided before purchase.
Conclusion of the contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
The customer can select a product, add it to the cart and review and correct the order information before completing the purchase.
By clicking the final order button indicating that the order involves an obligation to pay, the customer submits a binding order.
The contract is concluded when Whodunit Games accepts the order electronically, for example by sending an order confirmation or making the purchased digital content available.
The customer will receive confirmation of the order electronically.
German law requires the final online-order step to make it unambiguous that the customer is placing an order involving payment.
Prices and payment
The total price applicable to an order is the price displayed during checkout.
Any applicable taxes are included in the displayed total price.
As all products are supplied digitally, no shipping costs apply.
The available payment methods are displayed during checkout. Payment is due at the time of purchase unless otherwise stated.
Delivery of digital content
Digital products are supplied electronically.
After successful completion of the purchase, the customer will receive access to the purchased digital content, for example through a download link or electronically delivered files.
Unless otherwise stated in the product description, the digital content is supplied without undue delay after the contract has been concluded and payment has been completed.
Under German law, digital content is considered supplied once the content itself, or a suitable means of accessing or downloading it, has been made available to the customer.

Right of withdrawal
Consumers generally have a statutory right to withdraw from a distance contract within 14 days without giving any reason. For digital content, the withdrawal period generally begins on the day the contract is concluded.
To exercise the right of withdrawal before it has expired, the customer must inform:

of their decision to withdraw from the contract by an unequivocal statement, for example by email.
It is sufficient for the withdrawal notice to be sent before the withdrawal period has expired.
Early expiry of the withdrawal right for digital content
Because Whodunit Games supplies digital content immediately after purchase, the statutory withdrawal right can expire when supply of the digital content begins.
For paid digital content not supplied on a physical medium, the withdrawal right expires once supply begins only if:
the customer has expressly agreed that supply may begin before the end of the 14-day withdrawal period;
the customer has acknowledged that, by giving this consent, the right of withdrawal will expire once supply begins; and
Whodunit Games provides the customer with the legally required confirmation.
Where immediate delivery is offered, this consent and acknowledgement will therefore be requested separately during checkout.
Effects of withdrawal
If a valid withdrawal is made before the withdrawal right has expired, Whodunit Games will reimburse payments received in connection with the withdrawn contract without undue delay and no later than 14 days after receiving notice of the withdrawal.
The reimbursement will normally be made using the same means of payment used for the original transaction unless otherwise agreed.
Refunds after delivery
Once the statutory withdrawal right has validly expired following the immediate supply of the digital content, there is no additional voluntary right to cancel the purchase or obtain a refund merely because the customer has changed their mind.
This does not affect the customer's statutory rights where digital content is not supplied, is defective, cannot reasonably be accessed, or does not conform to the contract.
German law gives consumers specific remedies for defective digital products, including the right to require the defect to be remedied and, in certain circumstances, to reduce the price or terminate the contract.
Personal-use licence and copyright
All digital products, game texts, characters, stories, graphics, clues, instructions and other materials supplied by Whodunit Games are protected by copyright and other applicable intellectual-property laws.
Purchase of a product does not transfer ownership of the intellectual property. Instead, the customer receives a non-exclusive, non-transferable licence to use the purchased materials for personal, non-commercial purposes.
The customer may:
print the materials needed to play the purchased game privately; and
provide individual player materials to the people participating in their own private game.
The customer may not, without prior written permission from Whodunit Games:
resell, sublicense or commercially distribute the files;
upload the files or substantial parts of them publicly;
share the complete game package with people who have not purchased the game, except for the individual materials reasonably required by participants in the customer's own game;
reproduce or distribute the game for commercial purposes;
sell altered or adapted versions of the materials; or
use the game to provide paid commercial events or services.
Private modification of printed materials for the customer's own game is permitted.
Statutory rights relating to digital content
The statutory provisions concerning digital products apply.
Nothing in these Terms & Conditions excludes or limits mandatory consumer rights relating to the supply, conformity or defects of digital content.
German law generally prevents businesses from using contractual terms to remove the statutory digital-product protections granted to consumers.
Liability
Liability is governed by the applicable statutory provisions.
Nothing in these Terms & Conditions limits liability where such limitation would be prohibited by law.
Applicable law
German law applies to contracts concluded with Whodunit Games.
If the customer is a consumer residing in another country, this choice of law does not deprive the customer of any mandatory consumer-protection provisions that would otherwise apply under the law of their country of habitual residence.
This follows the consumer-protection rule in Article 6 of the Rome I Regulation.
Changes to these Terms & Conditions
Whodunit Games may update these Terms & Conditions for future purchases where necessary.
The Terms & Conditions applicable to an order are those in effect when that order is placed. Later changes will not retroactively alter an already concluded contract.
